World famous artist
Mahi Binebine, famous painter and also writer, today recognized as the best-known artist in Morocco and his works are part of the permanent collection of the Guggenheim Museum in New York. Mahi Binebine, born in 1959 in Marrakech, abandoned teaching mathematics after eight years to devote himself to painting, sculpture and writing. His first work was published in 1992 and since then he has published ten novels. “The Stars of Sidi Moumen” has been translated into ten languages and adapted for the cinema by Nabil Ayouch. After studying mathematics in Paris for eight years, Mahi Binebine emigrated to New York from 1994 to 1999 and returned to Marrakech in 2002 where he currently lives and works. Rental of work
As with real estate rent, the company pays a monthly rent to dispose of the works. The monthly payment system makes it possible to offer an accessible service and to smooth out its cost.
On the other hand, the rental of work is assimilated to an operating expense incurred in the interest of the company (furniture arrangement of the premises).
This service is then subject to the common law regime for deductible expenses (art 39-1 of the CGI).
This means that rents are fully deductible from the company's taxable income, allowing you to deduct them from your taxes.
Leasing does not alter borrowing capacity and reduces the top of the balance sheet (excluding IFRS).
At the end of a rental you can of course acquire a work.
Leasing rents are deductible expenses and VAT is recoverable.
In case of purchase (first intention or post rental)
It falls within the advantageous legislative framework of corporate sponsorship.
Article 238bis AB of the CGI grants tax reductions to companies that purchase works of art by living artists.
“Companies which purchase original works by living artists and register them in a fixed asset account may deduct from the result of the acquisition exercise and the following four years, in equal fractions, a sum equal to the price of the acquisition.
The deduction thus made for each financial year cannot exceed the limit mentioned in the first paragraph of 1 of article 238 bis (0.5% or €10,000), reduced by the total of the payments mentioned in the same article.
To benefit from the deduction provided for in the first paragraph, the company must exhibit in a place accessible to the public or to employees, with the exception of their offices, the property that it acquired for the period corresponding to the exercise of acquisition and the following four years. »
In summary, IN CASE OF PURCHASE: This law allows you to deduct 20% of the acquisition price of the work each year for 5 years.

Example for the purchase of a work for €1000 (corporate sponsorship)
Carried out by a company with a turnover of €300,000
You will be able to deduct 20% of the purchase price of the work of art (for the benefit of the company) from your corporate tax for 5 years.
1000€ x 20% = 200€/year (capped at 300,000 x 0.5% = 1500€/year)
Or a tax gain for the company if you are subject to corporate tax of 33%:
200€ x 33% = 66€ over the year of acquisition and over the following 4 years (66€ x 5 years), i.e. a total reduction of: 330€ over 5 years
The work will ultimately come back to you at 1000 – 330 = 670€
Finally, be aware that works of art are not included in the amounts imposed by professional tax.
